스포츠 내기와 도박
이 연구의 목적은 스포츠에서의 내기와 도박의 법적 정체성을 명확히 규 명하기 위하여 스포츠내기와 도박의 의미, 법적 근거 및 판례, 사례 및 처벌 기준 등을 다음과 같이 고찰하여 결론하였다. 스포츠내기 시 판돈이 약 20만 원 이상이 되면 일단 위법성이 인정되고 스포츠도박으로써 도박죄 처벌 기 준에 해당될 수 있다. 특히 스포츠내기가 오락, 놀이, 재미로써 일시적이 아 니고 상습적이거나 액수가 20만원 이상의 고액일 때는 고발이나 고소 같은 법적 문제 발생 시 스포츠도박죄로써 사회적 지위 및 경제적 여건에 상관없 이 법적으로 처벌을 받을 수 있다. 따라서 스포츠내기 시 도박죄로 처벌 받 지 않으려면 내기를 하지 않는 것이 중요하다. 만약 밥내기, 술내기, 돈내기 등의 스포츠내기 시에도 총 10만원 내외의 내기를 하는 것이 좋으며, 판돈 20만원 이상의 스포츠내기를 하지 말아야 한다. ‘나는 괜찮겠지’라는 안일한 생각으로 스포츠내기를 20만원 이상의 고액으로 주기적이나 상습적으로 하 고 있다면 법적 처벌 대상이 되기 때문에 지금 당장 중지하고 앞으로도 자 제할 것을 당부한다.
A Study about Sports Betting and Gambling
The purpose of this study was to consider the meaning, the legal basis, the legal precedent, the case, the penalty standard, etc of sports betting and gambling for find out the legal identity of betting and gambling in the sports correctly. Through this study, the following conclusion were drawn; In the sports betting, the money set upon the betting table is over 200,000 won, it is illegal and it comes under the penalty standard of gambling crime. Specially, this sports betting is no amusement, play, enjoyment, and at one time etc, it is punished habitual and large amount over 200,000 won regardless of social position and economic condition as sports gambling crime. In conclusion, it is important that sports betting is not doing betting of eating, drinking, money etc in the sports. Therefore, if you want to sports betting, you should be even 100,000 won or under 200,000 won. Especially, it is significance that sports betting is not doing to anniversary or habitual under 200,000 won. If you doing to this sports gambling recently, I will hope to you should be discontinue and self-control right now.
